Environment and land court case in Kiambu Club Limited v Kiambu County Government & 2 others , 23 April 2026
The Court blocked the Kiambu County Government from forcing Kiambu Club Limited to cede 20 acres of its land, ruling the attempt unlawful and procedurally flawed
Court of Appeal case in KUDHEIHA v Tea Hotels Limited, 8 May, 2026
The court of appeal reaffirmed that court- attached property is under strict judicial custody and unauthorised private alienations are void.Execution failed due to missing decree, unregistered prohibitory order and auction notice falling short of mandatory 45 days.
Court of Appeal case in Okul & another v Ondieki & 3 others, 8 May,26
The Court of Appeal held that even a land sale that was never formally finalized can still result in the buyer gaining legal title through adverse possession.
Court of Appeal case in Embassy of Sweden, Nairobi v Kusewa & Mjomba, 12 June,2026
The ruling determined that local employment contracts fall under private law, meaning foreign embassies cannot claim absolute state immunity in local labor disputes. A subsequent Court of Appeal bench however granted the Embassy leave to appeal to the Supreme Court of Kenya.
Court of Appeal case in Consolidated Bank of Kenya Ltd v Njuguna,10 July, 2026
The dismissal was ruled unfair, not because the misconduct was untrue, but only because they failed to follow procedure: the disciplinary record didn't clearly establish the reason, and the termination letter was signed by someone lacking authority under the bank's own HR policy.
High Court case in Gulf African Bank v Halgan Megabids Limited & 7 others,13 August, 2026
The High Court at Nairobi ruled that the State must indemnify an innocent lender under Section 81 of the Land Registration Act when it relies in good faith on a flawed official land register to obtain a flawed official land search.
High Court case in re Estate of Karobia (Deceased), 14 August, 2026
The court ruled that an intention to give land isn't the same as actually giving it. Signed consent forms, verbal promises, half-finished paperwork, or a family member simply saying "Dad gave me this land" won't necessarily hold up. If the transfer was never legally completed while the person was alive, the land reverts to the estate and gets shared out through normal succession.
High Court Case in Gachoka & 3 others v The Cabinet Secretary, The National Treasury and Economic Planning & 11 others, 15 September, 2026
The Court declared the sale of the government's 15% Safaricom stake to Vodacom null and void ordering the shares to be returned to the state given that the Cabinet and Parliament failed to engage the public.It further ruled that the transfer of effective foreign control bypassed security reviews.
Recent Kenya Laws
The Capital Markets (Licensing Requirements) (General) Regulations, 2025.
The Regulations which repealed the 2002 regulations came into force on 11th December, 2025 aimed at responding to a market environment with digital distribution channels, automated advisory models and alternative trading systems, thus shifting from a rules-based, entity-focused regime to a more activity-based and supervisory-led framework. The Regulations provide that all existing licensees must achieve full compliance by 11th December 2026.
The (Draft) Financial Consumer Protection Framework, 2026
Seven Kenyan regulators,led by Central Bank of Kenya, have teamed up to set one set of consumer protection rules across banking, insurance, pensions, SACCOs, and more in order to protect retail and vulnerable consumers from emerging digital risks. It is aimed at shifting compliance from box-ticking compliance to actually measuring whether consumers are getting fair outcomes.
The Kenya’s Trust Administration Act, 2026
The Act commenced on the 25th of September, 2026. It Consolidates Kenya's trust law into one framework,revoking the old Trustee Act and Trustees (Perpetual Succession) Act. It also amends the Business Registration Service Act and the Registration of Documents Act. Key changes include: Trusts must be registered/incorporated to be valid,National Register of Trusts requires beneficial ownership disclosure,Ownership changes reported within 21 days; records to be kept for 7 years, outlines Trustee duties, qualifications, and penalties. Existing trusts get 24 months to bring records into compliance.
The Kenya National Council for Population and Development Act, 2026
The law was assented to by the President on 8th of September 2026 and commenced on 25th of September, 2026. It establishes theNational Council for Population and Development (NCPD) as a body corporate and Kenya's official national focal point for population and development matters for the first time via an Act of Parliament rather than an administrative order, aligning Kenya with regional/international norms. Gives NCPD a firm legal mandate to coordinate population and development planning, advise government on demographic issues, and integrate population data into national and county-level planning and budgeting.
The Air Passenger Service Charge (Amendment) Act, 2026
Assented on 8th of September, 2026, the Act streamlines how revenue from air passenger charges are administered and distributed, and not the charge amount itself. It introduces a new remittance mechanism requiring KRA to pay proceeds directly to four beneficiary agencies (KAA, KCAA, Kenya Meteorological Service Authority, and the Tourism Fund), replacing the old system where all funds first went into the KAA Fund before redistribution.
The Public Finance Management (Amendment) Act, 2025
Assented on 8th of September, 2026, the Act creates a framework for transferring functions between national and county governments covering costing, resourcing, financing, and accountability of transferred functions, plus related assets/liabilities. It strengthens accountability and prudent management of public resources at both national and county level.
The Office of the Data Protection Commissioner (ODPC) Draft Notice, Political Affiliation & Trade Union Membership as Sensitive Personal Data, 2026
Published on 11th of September, 2026, it empowers the Data Commissioner to prescribe additional categories of sensitive personal data. It adds political affiliation and trade union membership as new sensitive personal data categories but only in a specific context: cross-border transfers into Kenya, where the sending jurisdiction's own law already treats that data as sensitive/special-category.
The Gold Processing Bill, 2023
A national assembly bill sponsored by Hon. Bernard Shinali to formalize and regulate Kenya's gold sector, the bill has been moved to the Senate, committed to the relevant committee for review and public participation and due for the second reading on 8th of October 2026.
The Public Participation Bill, 2025
A national assembly bill sponsored by Hon. Otiende Amollo and Hon. Samuel Chepkonga that establishes a uniform legal framework for citizen engagement across national and county governments in Kenya, the bill has been moved to the Senate and is due for second reading on 8th of October, 2026
The Investment and Export Promotion Authority Bill, 2026
The National Assembly bill sponsored by the government and first read on 01/07/2026 proposes merging the Kenya Investment Authority (KenInvest) and the Kenya Export Promotion and Branding Agency (KEPROBA) into a single unified entity called the Kenya Investment and Export Promotion Authority.
The Kenya Intellectual Property Bill, 2026
The National Assembly bill sponsored by the government was first read on 02/07/2026. The Bill proposes to consolidate Kenya’s intellectual property framework into a single, modern statute.
The Trade Descriptions (Amendment) Bill, 2026
The National Assembly Bill sponsored by the Government and first read on 28/07/2026 aims to modernize consumer protection laws and regulate digital and physical commerce. It proposes to enhance inspection, seizure, and forfeiture capabilities for authorized trade officers.
The Legal Metrology Bill, 2026
The National Assembly bill sponsored by the government was first read on 28/07/2026. The Bill aims to establish a modern legal and administrative framework for the manufacture, sale, use, and repair of weighing or measuring equipment.
The Kenya Economic Zones Bill, 2026
The National Assembly bill sponsored by the government was first read on 28/07/2026. The Bill seeks to repeal both the Export Processing Zones Act and the Special Economic Zones Act, 2015, replacing parallel bureaucracies with a streamlined one-stop-shop licensing and regulatory framework for domestic and international investors.
The Architectural and Quantity Surveying Practitioners Bill, 2026
The National Assembly Bill sponsored by the Chairperson, Departmental Committee on Housing, Urban Planning and Public Works was first read on 05/08/2026. It repeals and replaces the existing legal framework governing architects and quantity surveyors, while expanding regulation to cover other built environment professions.
The Environment Laws (Amendment) Bill, 2024
The Senate Bill sponsored by Sen. Abdul Haji Mohammed of Garissa County was passed by the Senate with amendments and sent to the National Assembly for approval. It was first read at the National Assembly on August 12, 2026. The Bill proposes to amend the Forest Conservation and Management Act to boost afforestation and reforestation of indigenous forests in Kenya; promote tree-planting in all counties; and to amend the Climate Change Act to provide for the setting and formulation of strategies to achieve national environment targets and annual carbon sequestration targets.
