Recent Kenyan Court decisions
Court of Appeal Case in Romageco Kenya Ltd v Kisigwa, 12 june,2026
The Court of Appeal upheld an award of KSh 4,707,945.38 to an employee after finding that his employer unfairly dismissed him while he was recovering from illness. Instead of following the law, the company terminated his employment through a newspaper notice without giving him a chance to defend himself.
High Court Case in Diamond Trust Bank Kenya Ltd v Kariuki & another, 18 June,2026
The High Court has ordered Safaricom and DTB to pay a customer Ksh. 4.42 million that was fraudulently withdrawn from her bank account following a SIM swap fraud.The Court found that Safaricom failed to adequately prevent and respond to the unauthorized SIM swap, while DTB failed to detect and stop suspicious high-value transactions despite obvious red flags. It upheld the lower court's decision, ordering Safaricom to bear 60% of the loss and DTB 40%, reaffirming that organizations handling personal data and digital financial services must take proactive steps to protect customers from fraud.
High Court Case in Kagwanja v Industrial and Commercial Development Corporation, 25 June,2026
A loan advanced in 1994 was still the subject of litigation over three decades later. The case affrims that time does not diminish the importance of legal fundamentals. However old a dispute is, the courts will still expect parties to prove their case and remain bound by the issues they chose to plead.
Court of Appeal Case in Consolidated Bank of Kenya Ltd & another v Chebon, 26 June,2026
The Court of Appeal's recent decision highlights the risks assumed by guarantors who sign guarantees drafted in broad terms. A guarantor may remain liable even where a bank restructures a lending facility without the guarantor's direct involvement. Not only does a guarantor have to always read every clause, they must understand that their consent to variation may have been given in advance.
Employment and Labour Relations Court Case in Dzinyefa v Programme for Christian-Muslim Relations in Africa 26 June,2026
This Employment and Labour relations court decision affirms that before filing an employment claim, one mustverify that the right parties are sued. One cannot simply rely on the name appearing on one's payslip or employment contract. The employee must first establish the employer's legal status.Where the employer is a registered society, the proper parties to sue are ordinarily the officials or office bearers authorized to represent the society, and not the society itself.
High Court Case in Kenya Revenue Authority v Bristol Estate Limited & 3 others 26 June,2026
The High Court has ordered the restoration of Bristol Estate Limited to the Register of Companies, allowing KRA to pursue recovery of KSh 475.8 million in outstanding taxes. The Court held that dissolution of a company does not automatically extinguish a company’s tax liabilities. Allowing companies to avoid statutory obligations simply by ceasing to exist would undermine tax enforcement.
Recent Kenya Laws
The Finance Act, 2026
The Act was passed by the President on 26 June 2026. The Act amends various laws including the Income Tax Act, Value Added Tax Act, Excise Duty Act,Tax Procedures Act, Miscellaneous Fees and Levies Act, Affordable Housing Act, 2024, Stamp Duty Act and Road Maintenance Levy Fund Act. The Act introduces new compliance machinery that was absent from the Bill, most notably a mandatory export declaration regime for all importers, a VAT recharacterization of outsourcing and staffing costs, and a power for the Kenya Revenue Authority (KRA) to recover non-tax fees and levies as if they were tax. Most provisions take effect on 01 July 2026. The shortened income tax return deadlines and the non-resident repatriation rates take effect on 01 January 2027, and the new export declaration regime takes effect on 01 September 2026.
It is noteworthy that a number of the Bill’s proposals were dropped, including the deemed dividend on undistributed profits, activation-based excise on mobile phones, the removal of EAC excise preferences, and the one-month nil-return rule.
The Appropriations Act, 2026
The act has been assented to by President William Ruto, authorizing government expenditure of KSh4.82 trillion for the 2026/27 Financial Year and setting the stage for implementation of key programmes under the Bottom-Up Economic Transformation Agenda (BETA).
The Kenya Intellectual Property Bill, 2026
Introduced to the National Assembly on June 19, 2026, it combines the Industrial Property Act, Copyright Act, and Anti-Counterfeit Act into one law. It proposes to replace KIPI, KECOBO, and the Anti-Counterfeit Authority with the Kenya Intellectual Property Authority (KIPA) and sets up a single IP tribunal. If passed into law, the Bill will require businesses, innovators and rights holders to engage a single regulatory authority for all intellectual property matters. Businesses operating in technology, the creative industries, agribusiness and pharmaceuticals shuld scrutinise the Bill with respect to artificial intelligence provisions, the updated compulsory licensing regime and the enhanced border enforcement mechanisms.
